Staff Use of Cellular Telephones Policy 5325

BACKGROUND
Southern Westchester BOCES (“SWBOCES”) recognizes that the performance of certain job responsibilities may require the use of cellular telephones. This would be applicable for employees whose job function requires considerable time outside of their assigned office or work area and it is important to SWBOCES that they are accessible during work times. This would also be applicable if the job function of the employee requires them to be accessible outside of scheduled or normal work

hours.

OPTIONS
Employees who meet the criteria described in the background section and obtain approval from the Center Director or designee will have the option of a SWBOCES issued device and data plan to be used for SWBOCES business only or to receive an allowance to help offset the cost of a personal device. Employees who elect to have an SWBOCES issued device and also use it as their personal device will have a payroll deduction made by SWBOCES to cover the cost of any allowable personal activity performed on the SWBOCES device.

GOVERNANCE
The District Superintendent or designee is authorized to establish administrative regulations and procedures as may be necessary to carry out this policy. This regulation will be evaluated periodically to address changes in technology.

ACCEPTABLE USE
All cellular telephones (personal or SWBOCES-owned) used for SWBOCES business should be utilized in accordance with the SWBOCES Staff Acceptable Use Policy #6413 and Regulation #6413-R.

UNACCEPTABLE USE
Employees who are issued a SWBOCES-owned device will be responsible for any charges beyond the basic approved use of the device. This will include charges for unauthorized use of the device(s) while on vacation. Exceptions will only be considered with prior written approval from the Center Director and the Assistant Superintendent for Business.

USING DEVICES WHILE DRIVING
Employees must adhere to all local laws when using personal or SWBOCES-owned devices while operating a motor vehicle. SWBOCES will not be responsible for costs associated with violating laws governing the use of cellular telephones while driving.
